The following agreement is in addition to our Terms of Service, Acceptable Usage Policy and No Spam Policy specific to MailFly subcribers, between DigiServ™ Technologies cc., (here forth known as "DigiServ™"), and MailFly customer(s).
WHEREAS, DigiServ™ is an information provider, offering data storage and transfer services over the Internet, through web servers;
WHEREAS, MailFly customer is a person or organisation who is engaging in utilising the MailFly products through DigiServ™;
In consideration of the mutual promises contained herein, the parties agree as follows;
1) Opt-in only lists
Each recipient must have provided verifiably granted intentional permission to receive mailings by either:

Written or email evidence. |

Electronic evidence such as a time and date stamp and IP address. |
The inability to supply adequate evidence of an opt-in mailing list may result in immediate account suspension.
2) Anti-Spam
Unsolicited bulk email (also known as spam) or Unsolicited commercial email (UCE) as per our AUP is strictly prohibited. Any MailFly customer engaged in the following actions will face immediate suspension.

Using MailFly to send either UCB or UCE. |

Any attempt to manipulate the Web Links appended automatically to the footer of each outgoing message by MailFly. |
|
Any account found to be utilising any misleading, false content, or attempting to distribute illegal information will be immediately suspended and reported to the appropriate authorities. |

If you know of any DigiServ™ client that is or might be violating this policy, please send a message or, if possible, forward the SPAM or UCE in full
